My Lord,

With reference to Canton despatch No. 53

of June 5th, I have the honour to transmit

herewith copy of a despatch from the Acting Consul

General at Canton enclosing a claim by the China

Navigation Company, Limited against the Chinese

Government in respect of the piracy of their steamer

"Tean" and to request your instructions in the matter.

2. The presentation of a clain might lead the

Canton authorities to deal with Bias Bay a little

more vigorously bit it might on the other hand set

an inconvenient precedent and lead to claims being

presented against for instance the Hong Kong Government

in cases where it could be shown that a pirated steamer

had been boarded by the pirates in Hong Kong. In

the case of the piracy of the China Navigation Company

s.s. "Tungchow" it will be remembered (Foreign Office

despatch No. 358 (F 1506/84/10) of May 12, 1926) that

it was decided not to present a claim against the Chinese

authorities but there it was admitted that the pirates had

boarded the ship from the French concession in Shanghai and

the Chinese authorities were clearly not at fault seeing

that they have no jurisdiction in the French settlement.
